Seafarers should be designated as keyworkers during future global pandemics.

Designating transport workers, including seafarers, as keyworkers and ensuring such workers’ needs and challenges are voiced during a pandemic are among the recently published recommendations from a joint United Nations and industry sector action group.

The Joint Action Group was established in December 2021 to review the impact of the COVID-19 pandemic on the world’s transport workers and the global supply chain. The Group included IMO, the International Labour Organization (ILO), the World Health Organization (WHO), the International Civil Aviation Organization (ICAO), the International Chamber of shipping (ICS) and the International Transport Workers’ Federation (ITF), and air and road entities.

The recommendations of the Joint Action Group to review the impact of the COVID-19 pandemic on the world’s transport workers and the global supply chain (JAG-TSC) aim to minimize adverse impacts on transport workers, their families and global trade and supply chains, while at the same time ensuring that public health needs are fully safeguarded and local communities are protected.

The 23 recommendations include, inter alia:

  • Setting up a rapid-response group for immediate activation in the event of WHO-declared Public Health Emergency of International Concern (PHEIC).

  • Engaging in effective social dialogue with global, regional and national transport employers and workers and their organizations in recognition that social dialogue is an effective means to improve the living and working conditions of mobile and cross-border transport workers and transport facilitation across international borders.

  • The United Nations system should convene a tripartite, international and inter-ministerial meeting to discuss transport, health and the common concerns and interests of the transport sector in order to identify the different approaches required to safeguard and respect the rights of workers and employers during PHEICs.

Amongst specific recommendations for IMO, ILO and ICAO:

  • Contributing to WHO guidance to mainstream the rights, needs and challenges of workers and employers in the transport sectors during PHEICs.

  • Voicing and mainstreaming workers’ and industry’s needs and challenges by engaging in the development of a future WHO convention, agreement or other international instrument on pandemic prevention, preparedness and response, as well as potential amendments to the International Health Regulations (IHR 2005) in line with the modalities of engagement for relevant stakeholders.

Amongst specific recommendations for Governments:

  • Recognize the key role played by transport workers during PHEICs, in particular mobile and cross-border transport workers that serve the sustainment of essential supply chains, and, if not having already done so, designate them as “key workers”.

IMO action during the pandemic

The recommendations reflect IMO’s calls made during the COVID-19 pandemic to designate seafarers as key workers and joint calls to collaborate on seafarer issues.

Furthermore, IMO’s Facilitation Committee has adopted amendments to the Facilitation Convention (which enter into force on 1 January 2024), to include provisions derived from lessons learned during the course of the COVID-19 pandemic. Contracting Governments and their relevant public authorities are required to allow ships and ports to remain fully operational during a PHEIC, in order to maintain complete functionality of global supply chains to the greatest extent possible. Public authorities are also required to designate port workers and ships’ crew as key workers (or equivalent), regardless of their nationality or the flag of their ship, when in their territory.

P&O Ferries sackings disregard for workers’ rights P&O Ferries

DP World sells itself as a progressive business concerned with social and corporate responsibility that supports labour rights. The company now has serious questions to answer following the ruthless sacking of 800 seafarers at its subsidiary P&O Ferries.

On March 17, P&O Ferries fired 800 British-based seafarers with 30 minutes notice over a pre-recorded Zoom call. The company made the decision without any consultation with its workforce or their unions.

The International Transport Workers’ Federation (ITF) and European Transport Workers’ Federation (ETF) are calling on DP World to engage in meaningful dialogue with affiliates RMT and Nautilus International about P&O Ferries’ future.

“DP World’s callous decision to sack 800 hard-working seafarers represents a brutal attack on their dignity,” said Paddy Crumlin, President of the ITF and Chair of ITF’s Dockers’ Section. “In doing so, they’re breaching laws and failing to meet their own company’s standards.”

Further, ETF President Frank Moreels pointed out that the use of non-union replacement labour amounts to a fundamental breach of workers’ rights to freedom of association.

“Their plan to outsource the jobs is in tatters. Reports are coming in across Europe that their original strategy was to replace the sacked workers with Russian and Ukrainian seafarers,” said Moreels.

In the Zoom sacking, P&O Ferriestold workers this was a “tough” decision, but it would “not be a viable business” without the changes.

In fact, P&O Ferries’ owner DP World has made record revenue and profits throughout the pandemic, turning over $10.8bn in revenue and $1.2bn in profit last year, a 33% increase in profit compared with the previous year. The company has paid out $376.1 million in dividends to shareholders over the past two years alone.

ITF President Paddy Crumlin made it clear that: “In the interest of the 800 workers who have lost their jobs, we are ready and willing to facilitate dialogue between the company and the unions, but we also stand ready to provide meaningful solidarity across DP World’s global operations if need be to defend these workers’ jobs.”

“P&O Ferries broke the law and must be penalized.”saidMark Dickinson, General secretary ofNautilus International. In the statement, he mentioned that UK lawplaces a duty on any employer proposing to dismiss as redundant 100 or more employees at one establishment within a period of 90 days or less to notify the flag state, in writing, of their proposal before giving notice to terminate an employee’s contract of employment in respect of any of those dismissals, and at least 45 days before the first of those dismissals takes effect. If the redundancies number 20 or more employees (but less than 100), the notice period is 30 days.

In 2020, P&O Ferries fully complied with the law in announcing and consulting on 1,100 redundancies across the business. In 2022, Mr Hebblethwaite, P&O chief executive, has freely admitted in his letter to the Government that notification was made to the “relevant authorities” on 17 March 2022.

Nautilus International

Nautilus International expects the government to take all possible action against these law breakers, who think they can buy silence and bully seafarers into unemployment or accepting lower wages and detrimental and unsafe terms and conditions of employment.

An Implementation Guide for the Management of COVID-19 on board Cargo Ships

The World Health Organization published an implementation guide for the management of COVID-19 on board cargo ships and fishing vessels. Ship personnel, whether working on ships engaged in cargo transport or fishing, typically work in close contact environments and are therefore susceptible to the transmission of coronavirus. A COVID-19 outbreak presents special risks for crew and officers making extended voyages without calling at any port and lacking access to shoreside medical facilities. Such an outbreak puts their safety and well-being at risk and may affect their ability to safely navigate and operate the ship.

The guide highlights that all ships and fishing vessels should have a written COVID-19 contingency management plan. Following its implementation, the plan should be tested regularly and updated as required. The plans should include surveillance and reporting, isolation and quarantine, case management, infection prevention and control measures, communication with authorities and training.

The guide is comprehensive. For Pre-embarkation, it covers port state requirements, ship requirements and preboarding screening. When onboard, it details the preventive measures, how to manage suspected and confirmed cases, transfer cases to shoreside medical facility for further treatment and manage contacts of cases etc. The guide also provides practical procedures to be implemented when leaving the ship, including public health measures, repatriation of ship personnel, vaccination and even mental health are revealed. Please refer to following website for full version of the guide: https://www.who.int/publications/i/item/WHO-2019-nCoV-Non-passenger_ships-2021-1
